Privacy Policy in accordance with EU Regulation 2016/679 (‘GDPR’).

What kind of data do we collect?

When you use our services, you agree that our company collects some of your personal data. This page is intended to tell you what data we collect, why we collect it and how we use it.

We deal with two types of data:

• Data provided by the user
• Data we automatically collect

User-provided data

If you are a private individual

If you are a private individual, when you register we ask you to provide us with certain data that we need to be able to provide you with our service. These are some examples of the data we ask you for:

• Address, email and password.
• Other data related to the type of your parking (e.g. we ask you for your car's brand, type, year of registration, plate number).

You may also choose to provide us with the following information:

• name
• date of birth
• sex
• town or municipality of reference
• phone number

As part of your use of the service, you may possibly use the ‘Messages’ and ‘Chat’ functions to communicate with our Customer Centre. For more details, please read section 7.1 ‘Messages and Chat’.

If you provide personal data of third parties, such as those of your family members or friends, you must be sure that these parties have been adequately informed and have consented to their processing in the manner described in this policy.

If you are under 16 years of age, you may not provide us with any personal data nor may you book or register with MyParking, and in any event we accept no liability for any untruthful statements you provide. If we become aware of any untrue statements we will proceed with the immediate deletion of any personal data acquired.

If you are a professional

If you are a professional, when you create a business account you are asked to provide some data:

• Company name, VAT number, contact name, email address, telephone number.
• Professional category and full address.

Data we automatically collect

We collect the following data through the services you use:

• Technical data: such as IP address, browser type, information about your computer, data about the (approximate) location of the tool you are using;
• Data collected using cookies or similar technologies: for more information, please visit the "Cookies" section.

How do we use the data collected?

We use the data collected to offer you our service every day, to inform you about our business activities or to offer you a more personalised service in line with your interests.

1.1. To guarantee your access to our services and improve their provision

We use your data to ensure your access to and delivery of our services, including:

• registration and creation of the private area
• publication of advertisements
• use of the "favourites" and "saved searches" functions
• communications related to the provision of the service
• messaging (Messages)
• contact with the Customer Centre also through the Chat function
• checking of reviews, moderating or removing content, preventing fraud
• administrative, financial or accounting activities, such as those relating to the purchase of services and eventual credit recovery

Such processing is necessary in order to properly provide the services of MyParking to its users.

We also use your data to improve and implement the service, through the following processes:

• detection of your current (approximate) location in order to facilitate the use of certain functions of the service, such as the display of advertisements of users near you
• communications relating to services similar to those you use
• market research, optional surveys and user satisfaction survey activities

Such processing is based on the legitimate interest of the Data Controller (see Section 3.1) and you can object to this at any time.

1.2. To inform you about our business activities

We use the data collected, where you have expressly given us consent, to inform you about promotional activities that may be of interest to you. In particular, we use it to:

• Communicate to you promotional, commercial and advertising activities on MyParking events, initiatives or partnerships, by e-mail, sending SMS or push notifications; only if you are a professional, by telephone calls through an operator, customer care service consisting in the offer of dedicated services during sales and after sales.
• Doing analysis and reporting activities related to promotional communication systems, such as tracking the number of e-mails opened, clicks made on links within the communication, the type of device used to read the communication and its operating system, or the list of unsubscribers to the newsletter.

1.3. Per offrirti un servizio personalizzato

We process the data collected, where you have expressly given us your consent, to analyse your consumption habits or choices in order to offer you a service that is increasingly personalised and in line with your interests and to improve our commercial offer. These analyses are not in any case related to an automated decision-making process.

The provision of personal data is compulsory exclusively for the processing required for the provision of the services offered by MyParking (any refusal for service provision purposes makes it impossible to use the service itself); on the other hand, it is optional for promotional and profiling purposes, and any refusal to provide consent has no negative consequences on the provision of the service offered on the website www.myparking.eu and related applications.

Which subjects are involved in the data processing?

3.1. Data controller

Data controller is COM-MEDIA SpA, in the person of its pro tempore legal representative, whose legal address is in Genoa (Italy) Via Manfredo Fanti, 10R - VAT number 01537840991.

The data controller uses data processors to achieve the purposes specified in point 1 to supervise the protection of personal data.

For any requests regarding your personal data please refer to point 3.2 below.

3.2. Contact information of the data controller

If you have any questions or requests regarding your personal data and your privacy, you can contact the data controller anytime at the email address privacy@myparking.it.

3.3. Subjects your personal data may be transferred to

The collected data may be transferred to:

• Companies that operates in the field of MyParking service, such as: subjects who provide parking service and passengers transportation service, direct marketing and customer care services, storage services, administrative services, payment and invoicing services, as well as companies that provide technical components essential to some functionalites of the service
• Administrative authorities as per legal obligations

Your personal data may be transferred outside the European Union to be processed by some of our service providers. In this case, we ensure that the transmission is carried out according to the current regulation and an adequate security level is guaranteed, based on European Commission standards or on Binding Corporate Rules.

Under no circumstances we sell or disclose your personal data to third parties.

How can you access, update or delete your data?

4.1. Access through your User Area and revocation of consent (opt-out)

You can access your data anytime through your User Area. Just log in and click on the section "Profile".

We remind you that you can revoke the given consent anytime by logging in your User Area and removing the corresponding flag.

4.2. Esportazione e cancellazione del trattamento dei dati personali

To export your personal data (takeout) or request their deletion, you can send a request to the email address privacy@myparking.it from the mailbox with which you have registered in MyParking.

Your personal data will be exported within 30 days or, if the export is particularly complex, within three months.

Deletion will be carried out within the technical timeframe and in accordance with the retention period explained in Section 5 below.

4.3. Exercise your rights

Any individual using our service may:

• Get from the owner any information about their personal data, if any, and the purpose and modality of data processing and get access to their personal data and to all the information referred to in Art. 15 of the GDPR
• Ask for update, correction, addition, deletion, restriction of data processing in case of any conditions referred to in Art. 18 of the GDPR, data anonymisation or data blockage, if unlawfully processed, including data whose storage is not necessary in accordance with the collection and/or processing purposes
• Completely or partially refuse the data processing, for justified reasons, even though relevant to the purpose of commercial information, of the sending of advertising material, of a direct sell, of market researches or of commercial communications. Furthermore, each user has the right to revoke their consent anytime without compromising the lawfulness of data processing based on the consent previously given
• Receive copy of their personal data, consciously and actively provided by using the service, in an document format easily readable from any device, and to trasmit them to another data controller
• Submit a complaint to Italian Data Protection Authority

How and how long will your data be stored?

Your data will be stored in paper and/or digital form and for the time necessary to fulfill the purposes mentioned in #1, respecting your privacy and the current regulation.

If you are an active user, ads and user-generated content will be stored for 60 months for security reasons, to moderate content and to prevent any conduct not in accordance with MyParking terms of use and publishing rules. The aim is to ensure a better quality of the service also in cooperation with the national Authorities.

For analyses aimed at developing and improving the service, user's data may be stored for the period of time mentioned above.

In order to inform you about news, offers and promotions exclusively on our services, we keep your data for a maximum period of 60 months. Personal profiling data, when provided by you, are not disclosed to third parties and in any case are not stored for more than 60 months.

Invoices, accounting documents and transaction related data will be stored for 11 years as provided by law (tax obligations included).

In case of a request of data cancellation according to the right to be forgotten, we remind you that those data will be stored and secured with access limited only to check and prevent crimes, for a period of time not longer than 12 months from the date of request and after that they will be deleted in a safe and irreversible way.

We remind you that for the same purposes, the data related to Internet traffic, excluding the content of communications, will be stored for a period of time not longer than 6 years from the providing date, in accordance with Art 24 of the law 167/2017 transposing EU anti-terrorism directive 2017/541.

If you do not perform any actions such as navigation, researches or any other use of the service on MyParking website for 27 months, you will be recognised as an inactive user and your data will be automatically deleted.

How do we secure your data?

Your data are collected by the subjects mentioned above, according to the applicable regulation, in particular according to the security requirements under GDPR (Art. 32): data are processed through appropriate manual or automated systems and according to the purposes mentioned in Point #1 to guarantee security and confidentiality of the data.

7.1. Messages and Chat

Messages and chat functionalities aim to perform an immediate communication between users and MyParking Customer Happiness Center to manage assistance requests and customer service activities related to the service.

We may check the content of the evaluation messages in order to moderate them for security reasons and to preserve the netiquette and MyParking publishing rules.

By using the messaging service, the user's identity (as signed up on MyParking) and the related content may be visible during active sessions.

We reserve the right to exclude from the messaging service, and from all MyParking services, those who do not comply with the rules and/or do not respect the purposes defined for the use of the messaging service, as well as all those whose behaviour is not correct nor respectful.

7.2. Surveys

We may ask you to participate to surveys in order to know your opinion and your level of satisfaction about the services provided. Those surveys may be carried out directly on MyParking website or through external platforms. You will be informed about their privacy policy.

During the surveys you may be asked to provide your email address (optional) to receive news and information about MyParking services.

We remind you that surveys participation is optional and you can refuse to answer any questions.

7.3. Position

If you use MyParking services and applications with your geolocalisation on, we may collect and process information about your current position (approximately). Those data are processed anonimously, in a format that does not allow any personal identification, and their aim is a better usability of some service functionalities based on the user's position. You can activate/deactivate the localisation services anytime by checking your browser and/or your mobile device settings as follows:

• Safari
• Desktop: go to “Preferences” > “Websites” > “Position” and remove MyParking from the list
• Mobile: devices: go to “Preferences” >”Privacy” > “Localisation” and deactivate Safari localisation

• Chrome
• Desktop: open Chrome chrome://settings/content/location and remove MyParking from the list
• Mobile devices: open Chrome and select “Website settings” > “Location” and remove MyParking from the list

• Firefox
• Desktop and mobile devices: open Firefox and tip the address about:preferences#privacy, search “Permission” > “Location” > “Settings” e remove MyParking from the list

• Internet Explorer
• Desktop: open Internet Explorer, click on the "gear" icon and select “Internet Options” in the privacy tab and at the item Position click the button “Delete Websites”

Will the privacy policy be updated in future?

This privacy policy may be subject to change. In case of substantial updates regarding the data use by the data controller, he will promptly notify the user by publishing them on the website or giving them adequate visibility through other media.
